Random thoughts on Capital Punishment


Punishment under jurisdiction is given to the accused to prohibit from committing the similar act and deterring the society from violating the law and order of the land.  Capital punishment is the extreme end of the punishment and is given in the cases in which accused considered is very harmful to the society. Though it was practiced throughout world, in recent times many countries have banned the capital punishment considering it is inhuman and constitution cannot take the life as the  it cannot give the life, . 

There is no universal law to give a capital punishment. In India, capital punishment is given in rarest of rare cases, while in countries like Saudi Arabia capital punishment is given even in case of theft, robbery etc. One of the objectives of capital punishments is to control the crimes which are considered as heinous like murders. In USA, capital punishment is given quite often to the guilty of murder. In this case, needless to say, capital punishment is given to control the crimes which amounted to murder. Surprisingly, in one recent analysis it was found that murders are increasing though capital punishment given cases are also increasing in the last decade. Here, the main objective of punishment to the control the crimes could not be achieved. Problem lies somewhere and it needs to be identified and solved. Capital punishment is not the solution and should be banned.

Justice is done based on the available facts. Capital punishment is given after careful study of evidences. However, there is a possibility that all the facts are not available or the facts produced in the court may not be true. Capital punishment is irreversible. There is always a possibility of human error in the judgment and analysis. If innocent is punished, it violates the famous saying in court that let 100 criminal set free but one innocent shall not be get punished. As capital punishment cannot be traced back, it should not be given.

At the birth every child is like a white paper -an innocent. The white paper can become a letter of love or a letter of hate. It is the society, environment in which one grows, socio-economic conditions and morality of the society are responsible for what is the future of  innocent children. In all the crimes except crimes committed by people with psychiatric disorder, society is a passive player. Indirectly it is the society that is responsible. Giving the capital punishment for just being a protagonist in the crime is not justified.

Capital punishment has no place in a matured civilized society. Alternative punishments can be given in place of capital punishments like life sentence. Equal distribution of natural resources, education and sound mental health can only reduce the crimes in a society.
